1. DEFINITIONS
The term "online sales contract" refers to the purchase agreement ("Contract") regarding the Supplier's tangible movable goods, entered into between the Supplier and the Buyer within a distance selling system via electronic tools organized by the Supplier. The term "Buyer" refers to the consumer, a natural person, who makes the purchase for purposes not related to any commercial or professional activity carried out. The term "Supplier" refers to the entity performing the sale of the goods covered by this contract.
2. IDENTIFICATION AND OBLIGATIONS OF THE PARTIES
Supplier: The goods subject to these general conditions are offered for sale by Extreme Design srl, with registered office in Via dei Mugnai 34/1 - 34/3 - 59100 Prato (PO), Italy, Tax Code and VAT No. 02041350972. Buyer: Expressly declares to make the purchase for purposes unrelated to any commercial or professional activity exercised and undertakes not to trade the items purchased.
3. OBJECT AND CONCLUSION OF THE CONTRACT
By this Contract, the Supplier sells and the Buyer purchases at a distance, via electronic tools, only the tangible movable goods indicated and offered for sale on this website. The Contract between the Supplier and the Buyer is concluded exclusively via the internet through the Buyer's access to the address www.bombata.it, where, by following the indicated procedures, the Buyer will formalize the proposal for the purchase of the goods. The conclusion process occurs through the online submission of an irrevocable order by the Buyer, by filling out and submitting the online order form, which will be displayed on the printable order summary web page, containing the details of the payer and the order, the price of the purchased good, shipping costs, payment methods and terms, and the delivery address. Upon receipt of the order, the Supplier will send a confirmation email and/or display a printable confirmation and summary web page. The contract is considered concluded and effective between the parties only upon execution of the order and the issuance of the relative invoice by the Supplier, the latter having the right to not accept or to reject the order until that moment. The sales invoice will be issued by Filedo in paper form and included inside the package containing the ordered products.
4. PAYMENT AND REFUND METHODS
The Supplier exclusively accepts advance payment for ordered products via major Credit Cards (Mastercard and Visa) and PayPal, without the Supplier becoming aware of the credit card details. Any refund to the Buyer, if entitled, will be credited via the same credit card or bank account within 30 days from the date the Supplier became aware of the cause generating the right to a refund.
5. DELIVERY TIMES AND METHODS
The Supplier will deliver the ordered products via courier. Order processing times may vary from the day of the order itself to a maximum of 7 working days, during which the invoice will be issued and the Contract concluded. If the Supplier is unable to ship within this period, the Buyer will be notified via email with a new delivery deadline. Delivery times may vary depending on the destination.
6. SHIPPING AND DELIVERY COSTS
The Supplier ships under DDP (Delivery Duty Paid) terms to EU countries; therefore, goods will arrive directly at the destination without additional payments. For all other countries, DDU (Delivery Duty Unpaid) terms apply; therefore, the courier may present a separate invoice for duties and taxes required by local authorities. It is the Buyer's responsibility to inquire about local taxes and duties before placing an order.
7. PRICES
All sales prices are expressed in Euros (€) and constitute an offer to the public pursuant to Art. 1336 of the Italian Civil Code. They include VAT and any other taxes for deliveries within the EU. For non-EU deliveries, the courier may request additional amounts for local taxes/duties. Shipping costs will be calculated during the purchase process. Prices are valid until the order is submitted. The Supplier may change prices at any time; however, the price displayed on the order summary page shall prevail.
8. PRODUCT AVAILABILITY
The Supplier ensures the processing of orders without delay. If an order exceeds the stock quantity, the Supplier will inform the Buyer via email regarding the unavailability or the waiting time, asking whether they wish to confirm the order. The Supplier's system confirms the registration of the order by sending a summary email, which does not constitute a legal obligation as it is a simple order summary.
9. LIMITATION OF LIABILITY
The Supplier assumes no liability for service interruptions due to force majeure if unable to execute the order within the contractually agreed time. The Supplier is not liable for internet malfunctions beyond its control, except in cases of willful misconduct or gross negligence. In the event of non-performance for reasons not attributable to the Supplier, the Buyer is only entitled to a full refund of the price paid. The Supplier is not liable for fraudulent use of credit cards by third parties, provided it demonstrates it adopted all standard diligence precautions.
10. WARRANTIES AND ASSISTANCE
The Supplier is liable for any established defect or fault attributable to it, provided that such defect is reported via email to info@bombata.it within the mandatory deadline of eight days from delivery, under penalty of forfeiture.
11. OBLIGATIONS OF THE BUYER
The Buyer undertakes to pay the price in the time and manner indicated. Once the online purchase is complete, the Buyer undertakes to print and keep the web page containing the order data and these conditions.
12. RIGHT OF WITHDRAWAL
The Buyer has the right to withdraw from the contract without penalty and without specifying a reason within 14 (fourteen) days from delivery. Please refer to the "Claims and Returns" page for more information.
13. PROTECTION OF PRIVACY AND DATA PROCESSING
The Supplier protects the privacy of Buyers in compliance with Legislative Decree no. 196/2003. Personal and tax data are collected for the purpose of order registration and contract execution. The Supplier undertakes to treat data confidentially and not to disclose it to unauthorized persons. The Buyer enjoys the rights under Art. 7 of Legislative Decree 196/2003, including the right to update, correct, or delete data.
14. COMMUNICATIONS AND COMPLAINTS
Written communications and complaints shall only be considered valid if sent to: Extreme Design srl, Via dei Mugnai, 34/1 - 34/3 - 59100 Prato (PO), Italy.
15. CONTRACT STORAGE
Pursuant to Art. 12 of Legislative Decree 70/03, the Supplier informs the Buyer that every order sent is stored in digital form on the server hosting the site according to confidentiality and security criteria.
16. DISPUTE RESOLUTION AND APPLICABLE LAW
For any dispute where the Parties intend to seek judicial authority, the competent Court shall be that of the Buyer's place of residence. The Contract is governed by Italian Law.
17. DURATION AND EFFECTIVENESS
Order confirmation implies acceptance of these general conditions. These conditions may be updated or modified at any time; the version displayed on the summary page at the time of the order shall be binding.
